Please read these Terms of Service ('Terms') carefully before using the PureForty website or services. By accessing our website, submitting a health intake, or completing a purchase, you agree to be bound by these Terms. If you do not agree, do not use our services.
1. Acceptance of Terms
These Terms constitute a legally binding agreement between you and PureForty ('we,' 'us,' or 'our'). By using our website, completing a health intake, or purchasing services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. Your use of our services constitutes your acceptance of these Terms at the time of each visit or transaction.
2. About PureForty
PureForty operates a technology platform that facilitates access to telehealth services and compounded prescription medications for weight management. We are not a healthcare provider, medical practice, or pharmacy.
Clinical services on the PureForty platform are provided exclusively by independent licensed clinicians operating through the OpenLoop Health network. All clinical decisions — including diagnosis, treatment planning, and prescribing — are made solely by those clinicians, not by PureForty. PureForty does not employ clinicians, does not practice medicine, and does not direct clinical care.
3. Eligibility
To use PureForty's services, you must meet all of the following requirements:
- Be at least 18 years of age
- Be a legal resident of the United States residing in a state where our services are available
- Provide truthful, accurate, and complete information on your health intake form
- Be determined medically eligible for treatment by a licensed clinician
Eligibility for treatment is determined solely by the prescribing clinician based on your health intake. Meeting the above requirements does not guarantee approval for medication. Providing false or misleading information on your health intake is a material violation of these Terms and may result in account termination without refund.
4. Telehealth Services
Telehealth services available through PureForty are provided by independent licensed clinicians through the OpenLoop Health platform. Consultations are conducted asynchronously — meaning a clinician reviews your health intake and responds without requiring a live video appointment.
Prescriptions are issued at the sole discretion of the licensed clinician based on their independent clinical judgment. PureForty does not review, approve, or influence prescribing decisions. There is no guarantee that submitting an intake will result in a prescription.
PureForty is not responsible for clinical decisions made by independent providers. If a clinician determines that treatment is not appropriate for you, that decision is final and at the clinician's discretion. You should seek in-person medical care for any urgent or complex health concerns.
5. Compounded Medications
Medications dispensed through the PureForty platform are compounded drug products prepared by licensed compounding pharmacies. Compounded medications are customized formulations not commercially available as finished drug products.
Compounded drug products are not FDA-approved finished drug products and have not been evaluated by the FDA for safety, effectiveness, or quality. The use of compounded medications involves inherent risks that differ from FDA-approved medications. By proceeding with treatment, you acknowledge and assume these risks.
Compounding pharmacies used by PureForty are accredited and licensed in the states where they operate. However, PureForty makes no warranty as to the safety, efficacy, or quality of any compounded medication dispensed through our platform.
6. Payment Terms
Payment is due in full at the time you place an order. PureForty does not offer subscriptions. We do not charge your payment method automatically or ship medication without your explicit order for each treatment cycle.
Prices for all services and medications are listed on our pricing page. Prices are subject to change at any time without notice. The price displayed at the time of your order confirmation is the price you will be charged.
Payments are processed by a third-party payment processor. PureForty does not store your full payment card number. We accept Visa, Mastercard, American Express, and FSA/HSA cards.
7. Refund Policy
If your health intake is not approved by a clinician, you will receive a full refund of any amounts charged. For all other refund circumstances, please review our Refund Policy, which is incorporated into these Terms by reference.
8. Prohibited Uses
When using PureForty's platform, you agree not to:
- Submit false, misleading, or fabricated information on your health intake form
- Use our services for any purpose other than obtaining treatment for yourself
- Resell, redistribute, or transfer any medication obtained through PureForty to any other person
- Share your prescription medication with any other individual
- Attempt to circumvent clinical review, identity verification, or prescribing requirements
- Engage in fraudulent, abusive, or illegal activity in connection with our services
- Use automated tools, bots, or scripts to interact with our platform
Violations of these prohibitions may result in immediate account termination, forfeiture of amounts paid, and referral to appropriate legal or regulatory authorities where required by law.
9. Intellectual Property
All content on the PureForty website — including text, graphics, logos, icons, images, and software — is the property of PureForty or its content suppliers and is protected by applicable intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content from this site without our express written permission.
10. Disclaimer of Warranties
The PureForty website, platform, and services are provided on an "as is" and "as available" basis, without warranties of any kind.
To the fullest extent permitted by applicable law, PureForty expressly disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. PureForty does not warrant that the site will be uninterrupted, error-free, or free of viruses or other harmful components. PureForty does not warrant any specific outcomes from use of its services or from treatment with compounded medications.
11. Limitation of Liability
To the maximum extent permitted by applicable law, PureForty and its affiliates, partners, officers, employees, agents, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including but not limited to loss of profits, data, goodwill, or other intangible losses — arising from or in connection with your use of, or inability to use, our services.
In no event shall PureForty's total cumulative liability to you for any claim arising out of or relating to these Terms or our services exceed the total amount you paid to PureForty in the ninety (90) days immediately preceding the event giving rise to the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless PureForty and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to: (a) your use of our services; (b) any misrepresentation or omission in your health intake form; (c) your violation of these Terms; or (d) your violation of any applicable law or regulation.
13. Dispute Resolution
Before filing any formal claim, you agree to contact PureForty at legal@pureforty.com and attempt to resolve the dispute informally. We will make reasonable efforts to resolve any concerns within 30 days of receiving written notice.
If informal resolution fails, you agree that any dispute, claim, or controversy arising out of or relating to these Terms or the services shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted in English and may be conducted remotely.
YOU AND PUREFORTY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. This waiver applies to all claims arising under these Terms or in connection with PureForty's services.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. To the extent that any dispute is not subject to arbitration under Section 13, you and PureForty consent to the exclusive jurisdiction of the state and federal courts located in Texas for resolution of such disputes.
15. Changes to Terms
We reserve the right to update these Terms at any time. When we do, we will revise the 'Last Updated' date at the top of this page. For material changes, we will notify registered patients via email at least 14 days before the change takes effect. Your continued use of our services after any update constitutes your acceptance of the revised Terms.
